The short version

1        We collect what we need to answer you, take your booking and look after you while you are here.

2        We do not sell your information. Ever.

3        We keep it as long as we need it, and as long as the law says we must, and then we get rid of it.

4        You can ask us what we hold, ask us to fix it, and tell us to stop emailing you.

The rest of this page is the detail behind those four lines. Our full PAIA and POPIA Manual is also on this website, and it is the complete version. If this page and the manual ever say different things, the manual is the one that counts.

What do we collect?

Only what we need, and only when we need it.

When What we collect
You enquire or book Your name and contact details, your booking and travel plans, who is coming with you, and your payment details.
You arrive The guest details we are required to record, including identity or passport details. If you tell us about a food allergy or a medical condition, that too.
You browse the site Basic information about your device and the pages you look at, through cookies. Our Cookie Policy explains that side of things.
You sign up for news Your name, your email address and what you would like to hear about.
You apply for a job with us Whatever is in your application, and the documents that show you may work here.
You come through the gate Gate and access records, and camera footage where cameras are running.
You supply us, or send us guests The contact and account details we need to work with you.

If we ever ask for something we do not strictly need, we will say so, and it is up to you whether to give it.

Why do we use it?

For seven things, and nothing else. The law says we must have a proper reason for each, so here they are.

What we use it for Why we are allowed to
Answering you, taking your booking, giving you the stay you paid for It is what we agreed when you booked
Keeping you safe on a Big 5 property, and keeping our staff safe It is a fair and necessary part of running a lodge, and safety law requires it
Keeping the records the law makes us keep, such as tax, employment and conservation records The law requires it
Taking payment, and following up if something is unpaid It is what we agreed, and it is a fair use of your details
Telling you about the Lodge You asked us to, or you have stayed with us. Either way, every message has an easy way out
Catering for your allergies, and getting help to you in an emergency You chose to tell us, on the form
Sorting out a dispute, if one ever arises It is a fair use of your details

What about allergies and medical information?

We treat it carefully, because the law says it deserves extra care and because it matters.

We ask so that we can feed you safely and get help to you quickly, which counts for a lot when the nearest town is not close. It goes to our kitchen, to your guide, and in an emergency to medical services. Nowhere else.

You give it to us because you choose to, and you can change your mind at any time. The only catch is the obvious one. We cannot cater for something we do not know about.

What about children?

When a child stays with us we take their details from a parent or guardian, and we use them only to look after the child safely. We never market to children.

Who else sees it?

We do not sell your information and we do not rent it out. It goes only to the people who need it to give you your stay.

1        The companies that run parts of our business for us. Our booking system, our website host, our email provider, our payment processor and the people who do our accounts and payroll. They may use your information only as we instruct, and they have to keep it safe.

2        Travel agents, tour operators and booking platforms, when your booking came through them or when they are arranging part of your trip.

3        Transfer, activity and medical providers, when that is what it takes to give you what you booked or to help you in an emergency.

4        Anyone the law says we must tell, and our advisers if we ever have to defend a claim.

Annexure C of our manual lists these by category.

Does anything leave South Africa?

Some of it, yes. A few of the systems we use store their data overseas, which is ordinary for a business like ours. The law only allows that in defined circumstances, and we rely on one of them every time, usually because the company holding it is bound by protections much like ours, or because it is the only way to give you the booking you made.

Annexure D of our manual sets out where it goes and on what basis.

How long do you keep it?

For as long as we need it, and then for as long as the law says we must, which for most financial and employment records is five years. Camera footage is kept for a short while and then written over, unless something happened that we need it for. After that we delete or destroy it.

How do you look after it?

With access controls on our systems, passwords that are not shared around, backups, and old fashioned care with the paper we keep at the lodge. Annexure E of the manual has the detail.

If something ever goes wrong and your information is exposed, we will tell the Information Regulator and we will tell you. That is not a courtesy, it is the law, and we would want to know too.

What can you ask us to do?

Any of the following, at no cost, apart from the fee the law lets us charge for finding and copying records if you ask for a full copy.

1        Ask us what we hold about you, and ask for a copy.

2        Ask us to correct anything that is wrong.

3        Ask us to delete anything we no longer have a good reason to keep.

4        Object to us using your details, where we are relying on it simply being a fair use.

5        Tell us to stop emailing you. That one takes effect immediately.

6        Complain to the Information Regulator if you are not happy with how we handled it.

Send any of these to info@nyatisafarilodge.co.za, marked for the Information Officer. Our Information Officer is Jorgen Nielsen and our Deputy Information Officer is Juan Weerts. Their full details are in clause 3 of the manual, along with the form to use if the law prescribes one.

The Information Regulator can be reached at enquiries@inforegulator.org.za, on 010 023 5200, and at inforegulator.org.za. For complaints about access to information, PAIAComplaints@inforegulator.org.za. For complaints about personal information, POPIAComplaints@inforegulator.org.za.

Will you email me?

Only if you asked us to, or if you have stayed with us and we think you would like to hear what is happening at the Lodge. Every message we send has a one click way to stop it, and if you use it, that is the end of it. We do not pass your details to anyone else for their marketing.

Does this page change?

We look at it once a year, and any time something changes that would make it wrong. The date and version are at the top. Whatever is published here is what applies.
